This policy applies to digital content not supplied on a physical medium (for example: downloadable themes, templates, or software). All orders are delivered immediately after checkout.
At ThemeUp Studio, we take pride in crafting high-quality Ghost CMS themes designed to elevate your content and website experience. As our products are digital downloads, all sales are considered final.
1) Cooling-off rights & instant delivery (EU/EEA)
EU/EEA consumers generally have a 14-day right of withdrawal for distance purchases. For immediate digital downloads (no physical medium), that right does not apply once:
- you give prior express consent for immediate supply;
- you acknowledge you lose the 14-day right of withdrawal when delivery starts; and
- we send you confirmation on a durable medium (e.g., email receipt including your consent text).
How we implement this: At checkout, we display a required consent box (unticked by default). When you tick it and complete payment, your download begins immediately and your 14-day withdrawal right no longer applies to that order. We keep a durable record (consent text, timestamp, order ID).
Your non-waivable rights remain: If the digital content is defective or not as described, EU law provides remedies (e.g., repair, replacement, price reduction, or refund if appropriate).
2) United Kingdom
For instant digital downloads, UK law mirrors the EU position: if you request immediate supply and acknowledge losing the 14-day cancellation right, you cannot cancel on “cooling-off” grounds after delivery starts.
Separately, under the Consumer Rights Act 2015, you have non-excludable remedies for faulty digital content (repair/replacement or a price reduction/refund if the issue cannot be fixed).
3) Australia
There is no general cooling-off right for instant digital downloads. The Australian Consumer Law (ACL) provides non-excludable consumer guarantees (acceptable quality, fit for purpose, as described).
- Major failure: you can choose a refund or replacement.
- Non-major failure: we will repair, replace, or refund within a reasonable time.
4) New Zealand
The Consumer Guarantees Act (CGA) applies to digital products. There is no automatic cooling-off right for instant downloads, but if guarantees aren’t met (fit for purpose, acceptable quality, etc.), you’re entitled to repair, replacement, or refund depending on the issue.
5) Other countries
Consumer protection rules vary. Where local law grants non-excludable rights (withdrawal rights, mandatory guarantees, or specific remedies), those rights will apply and prevail over conflicting contract terms.
6) When we do issue refunds
Even with instant access, we’ll provide a refund or other remedy where required by law or this policy. Typical examples include:
- Duplicate payment (charged twice for the same order).
- Defective or misdescribed digital content where we cannot remedy the defect or provide a suitable replacement.
- Unauthorized transaction (fraud) after investigation with your payment provider.
7) When refunds are not available
Because we grant access immediately after your explicit consent:
- Change of mind after access begins (EU/UK cooling-off does not apply once you’ve consented and delivery has started).
- Incompatibility where your setup does not meet our documented requirements (we’ll help troubleshoot).
- Third-party outages outside our control (e.g., hosting/CDN/payment gateway).
- Feature misunderstandings where the feature was not claimed in our product page or docs.
- Abuse or misuse (e.g., redistribution, unauthorized sharing).
- Change of any underlying software/tools/SaaS/CMS our product was intended to be used with.

9) How to request support or a remedy
Email [email protected] with:
- Order ID and checkout email
- A clear description of the issue and steps tried
- Any error messages or screenshots
- Your environment (CMS version, browser/OS, theme version)
We’ll acknowledge within 2 business days and aim to repair or replace promptly. If we cannot resolve a qualifying defect, we’ll offer a proportionate price reduction or a refund, as required by your local consumer law.
10) Chargebacks & disputes
Please contact [email protected] before filing a chargeback—most issues are technical and quickly fixable. If a chargeback is filed, we may revoke license keys and access for the disputed order while the investigation is ongoing. This does not affect your non-excludable consumer rights where applicable.
11) Records we keep
To comply with law and provide support, we store proof of consent (the exact consent text, date/time, IP/hash, order ID), delivery logs, and license/activation data. This helps confirm your entitlements and resolve issues. We handle personal data in line with our privacy practices (see the Privacy section on our website).
12) Subscriptions
If a product includes an ongoing subscription (updates, hosted features, or support plans), you can cancel the next term at any time before renewal. Access to subscription-only features ends when the term ends. Refunds for the elapsed billing period aren’t provided unless required by law (see the regional rights above).
